This Privacy Policy explains how Luxe Breakers LLC, a Florida limited liability company ("Luxe Breakers," "we," "us," or "our"), collects, uses, discloses, and protects personal information in connection with the website located at luxebreakers.com and any related services (collectively, the "Service").
This Privacy Policy is incorporated into our Terms of Service. Capitalized terms not defined in this Privacy Policy have the meanings given to them in the Terms of Service.

6. Your Rights and Choices

6.5 Right to Opt Out of Profiling and Automated Decisions
To the extent applicable law grants you a right to opt out of profiling or automated decision-making that produces legal or similarly significant effects, you may exercise that right by contacting us. We do not currently make decisions about you solely through automated means that produce legal or similarly significant effects.
6.6 Right to Non-Discrimination
We will not discriminate against you for exercising any of your privacy rights. We will not deny you service, charge different prices, or provide different quality of service based solely on your exercise of your rights.
6.7 Right to Appeal
If we deny your privacy request, you may appeal our decision by contacting us at [email protected] with the subject line "Privacy Appeal." We will respond to your appeal within the time period required by applicable law.
6.8 Marketing Email Opt-Out
You may opt out of marketing emails at any time by clicking the "unsubscribe" link at the bottom of any marketing email or by contacting us at [email protected]. Opting out of marketing emails will not affect your receipt of transactional emails such as order confirmations and shipping notifications.
6.9 How to Submit a Privacy Request

- The email address associated with your account
- A clear description of the right you wish to exercise
We will respond to your request within forty-five (45) days, with a possible extension for complex requests as permitted by applicable law.
6.10 Identity Verification
Before fulfilling certain privacy requests, we may ask you to verify your identity to prevent unauthorized access to your information. The specific verification steps depend on the sensitivity of the request.
6.11 Authorized Agents
You may designate an authorized agent to submit privacy requests on your behalf. We may require written authorization from you and verification of both your identity and the agent's identity.
7. Data Retention
We retain personal information for as long as necessary to provide the Service, comply with our legal obligations, resolve disputes, enforce our agreements, and support our legitimate business operations.
7.1 Account Data
We retain account data for as long as your account is active. If your account is closed, we retain certain account data for a period consistent with the retention rules below.
7.2 Transaction Records
We retain transaction records for seven (7) years after the transaction, to comply with tax, accounting, and record-keeping obligations.
7.3 Legal and Compliance Data
We retain personal information longer where required by law, for dispute resolution, for fraud prevention, or to enforce our agreements, for a period corresponding to the applicable statute of limitations or regulatory requirement.
7.4 Marketing Data
We retain marketing preferences (including opt-out status) indefinitely to honor your choices. Engagement data related to marketing is retained for as long as your account is active or until you opt out.
7.5 Anonymized Data
We may retain aggregated or anonymized data, which does not identify you, indefinitely.
8. Data Security
We implement reasonable administrative, technical, and physical safeguards designed to protect personal information from unauthorized access, use, disclosure, alteration, or destruction. No security measures are perfect, and we cannot guarantee the absolute security of any information.
You are responsible for maintaining the confidentiality of your account password and for all activity that occurs under your account. If you believe your account has been compromised, please notify us immediately at [email protected].
If we learn of a security incident affecting your personal information that requires notification under applicable law, we will notify you in accordance with that law.
9. Children's Privacy
The Service is intended for users who are at least eighteen (18) years of age. We do not knowingly collect personal information from individuals under the age of thirteen (13), consistent with the Children's Online Privacy Protection Act (COPPA), and we do not knowingly collect personal information from anyone under eighteen (18).

10. International Users
The Service is intended for residents of the United States only. If you are located outside the United States, please do not use the Service.

We may update this Privacy Policy from time to time. The "Effective Date" at the top of the policy indicates when the policy was last updated.
For material changes to this Privacy Policy, we will provide notice by email to the address associated with your account and by prominently posting the updated policy on the Service, in each case at least a reasonable period before the changes take effect.
Your continued use of the Service after the effective date of an updated Privacy Policy constitutes your acceptance of the updated policy, except where applicable law requires affirmative consent, in which case we will seek such consent.

We do not use or disclose sensitive personal information for purposes that would require the option to limit such use under the CCPA.
California Privacy Rights
California residents have the rights described in Section 6 of this Privacy Policy, including the right to know, access, delete, correct, opt out of sale or sharing, and non-discrimination. To exercise your rights, please follow the process described in Section 6.9. You may also use the "Do Not Sell or Share My Personal Information" and "Your Privacy Choices" links in the footer of the Service.
Authorized Agents
California residents may designate an authorized agent to submit privacy requests on their behalf as described in Section 6.11.
13.2 Notice to Residents of Other States
Residents of states including (as applicable) Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, Tennessee, Iowa, Delaware, New Jersey, New Hampshire, Nebraska, Minnesota, Maryland, Indiana, Kentucky, and Rhode Island have rights under their states' privacy laws that are substantively similar to those described in Section 6 of this Privacy Policy.
